1. Acceptance of Terms

By accessing and using the services provided by Outback Adventures Australia ("we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. We reserve the right to change these terms at any time without prior notice.

2. Use License

Permission is granted to temporarily download one copy of the materials on Outback Adventures Australia's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display (commercial or non-commercial)
• Attempt to decompile or reverse engineer any software contained on our website
• Remove any copyright or other proprietary notations from the materials

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Tour Booking and Payment Terms

All tour bookings are subject to availability and confirmation. We reserve the right to decline any booking at our discretion. Payment terms and conditions include:

• A deposit of 25% is required at the time of booking for all tours
• Full payment is due 60 days prior to departure date
• Late payment may result in automatic cancellation of your booking
• All prices are quoted in Australian Dollars (AUD) and include GST where applicable
• Prices are subject to change without notice until booking is confirmed and deposit received

4. Cancellation and Refund Policy

Cancellation by Customer

Cancellations must be made in writing and are subject to the following charges:

• More than 90 days before departure: 10% of tour cost
• 61-90 days before departure: 25% of tour cost
• 31-60 days before departure: 50% of tour cost
• 15-30 days before departure: 75% of tour cost
• Less than 15 days before departure: 100% of tour cost (no refund)

Cancellation by Outback Adventures

We reserve the right to cancel any tour due to insufficient bookings, weather conditions, or circumstances beyond our control. In such cases, we will provide a full refund or offer alternative dates/tours of equal value.

5. Travel Insurance and Health Requirements

We strongly recommend that all participants obtain comprehensive travel insurance covering trip cancellation, medical expenses, and emergency evacuation. Participation in our tours may require a certain level of physical fitness. It is your responsibility to ensure you are medically fit for the activities included in your chosen tour.

Health and Safety Requirements

• Participants must disclose any medical conditions that may affect their ability to participate
• Participants must follow all safety guidelines provided by our guides
• We reserve the right to remove participants who pose a safety risk to themselves or others
• Participants engage in activities at their own risk

6. Limitation of Liability

Outback Adventures Australia operates as a tour organizer and uses various suppliers to provide services. We act only as an agent for these suppliers and cannot be held responsible for their actions or omissions. Our liability is limited to the cost of the tour booked.

We are not liable for any indirect, special, or consequential damages, including but not limited to loss of profits, business interruption, or personal injury, except where such limitation is prohibited by law.

7. Force Majeure

We are not liable for any failure to perform our obligations where such failure results from acts of nature, war, terrorism, epidemic, government regulations, disasters, strikes, or other events beyond our reasonable control. In such cases, we will make reasonable efforts to provide alternative arrangements or reschedule tours.

8. Intellectual Property Rights

All content on this website, including text, graphics, logos, images, and software, is the property of Outback Adventures Australia and is protected by Australian and international copyright laws. Unauthorized reproduction, distribution, or display of this content is strictly prohibited.

Photography and Media Release

By participating in our tours, you grant us permission to use photographs or videos taken during the tour for marketing and promotional purposes. If you do not wish to be included in such materials, please inform your guide at the beginning of the tour.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

We implement appropriate security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction.

10. Environmental Responsibility

As a sustainable tourism operator, we expect all participants to respect the environment and local cultures. Participants must:

• Follow Leave No Trace principles
• Respect wildlife and natural habitats
• Support local communities and economies
• Minimize environmental impact during tours
• Follow all environmental guidelines provided by guides

11. Governing Law and Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of New South Wales.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable. The invalid provision will be replaced with a valid provision that most closely matches the intent of the original provision.
